Recently, we were hired by a law firm to negotiate a Veterans Administration lien where the plaintiff required revision surgery on his hip implant. The VA covered his healthcare costs of $34,000 for a different facility, however, they reported a lien of $120,000 – a $92,000 difference.
The VA asserted that if the plaintiff used one of its facilities, its lien would have been closer to $120,000 for those same services. It also claimed its argument is supported by existing legislation; however MASSIVE continued to negotiate that if the VA is able to collect $92,000 more than what it actually charged for these services; the VA would be unjustly enriched.
