A MASSIVE Lien Resolution Increases Settlement for Plaintiff
MASSIVE increases settlement and reduced liens by $1,500,000 for a motorcycle rider from Nassau County, New York. The 19 year old plaintiff was involved in an accident near a bridge within an unmarked construction zone. The case settled against the construction company for $4.8 million due to injuries sustained by the biker causing permanent brain injury. The liens on the case totaled over 3 million dollars due to his necessary, but costly care. New York Medicaid paid for most of his care at the time of the injury. In order to effectuate a settlement we needed to mitigate the liens as much as possible. HMS, who handles much of NY Medicaid, is challenging to work with, and liens can asserted by both the state and the county. It is not always clear who paid for treatment and bills must be scrutinized. MASSIVE was able to negotiate the system and reduce the liens so that the family would take home as much of the settlement proceeds as possible to pay for his care.
