Trump’s Proposed Medicaid Cuts – What it Means for Medicaid Liens
President Trump has proposed more than $800 Billion in cuts to federal Medicaid funding in his first major budget proposal. These cuts are far from certain today and may require a connection to the House’s health care bill passed last month. While many of these cuts mean that fewer people will be covered, what happens to the programs from our limited legal and lien-related perspective?
The simplest answer is we are likely to see fewer liens because fewer individuals are covered by Medicaid in each state. (Of course that doesn’t mean you shouldn’t check for coverage).
The more likely answer is that we see Medicaid programs fight harder to recoup their dollars via reimbursement in Medicaid liens. It is interesting to see this developing just a week after a Michigan appellate court ordered the state’s Medicaid program adhere to rules laid out in SCOTUS’s Ahlborn v. Arkansas. We plan to write more on that case in the coming days. Meanwhile, we have to wait and see just how deep those Medicaid cuts will go. Until then, expect Medicaid programs nationwide to ramp up their collection efforts in preparation for reduced funding.
