CMS Begins Teaching Providers About MSAs
CMS issued MLN Matters Number SE17019 on September 19, 2017. Its three pages have one clear intent: teach medical providers how to discover whether they should bill Medicare or the patient’s MSA account. Click here for the full text of MLN Matters Number SE 17019.
The article concludes with a section called, “Provider Action Needed.” That section explains when, “[it] is appropriate for you to document your records … and accept payment directly from the patient for such services.” More important is the preceding language that discusses not only workers’ compensation MSAs, but also, Liability MSAs (“LMSAs”), and No-Fault MSAs (“NFMSAs”).
This MLN Matters article is filled with references to Medicare being the secondary payer and LMSAs. It includes a discussion regarding the release of benefits creating an assumption that future care will be paid from the settlement.
